The Pen Draw Rules & Regulations

 5THE [DRAW] (THE “CONTEST”) IS INTENDED TO BE CONDUCTED IN CANADA ONLY WITH THE EXCEPTION OF THE PROVINCE OF QUEBEC AND SHALL BE CONSTRUED AND GOVERNED ACCORDING TO APPLICABLE CANADIAN LAW. THE CONTEST IS OPEN TO LEGAL RESIDENTS OF CANADA OUTSIDE THE PROVINCE OF QUEBEC ONLY. DO NOT ENTER THE CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF CANADA OR PRIMARILY RESIDE IN THE PROVINCE OF QUEBEC. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST BE OF THE AGE OF MAJORITY OR OLDER IN THEIR PROVINCE OR TERRITORY OF RESIDENCE AT THE TIME OF ENTRY. THE CONTEST IS VOID WERE PROHIBITED BY LAW. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).

  1. ELIGIBILITY. To be eligible for the Contest, an individual must:

be a legal resident of Canada with the exception of the Province of Quebec;

be of the age of majority in his/her province or territory of residence or older at the time of entry; and

be legally able to carry firearms and have a valid Possession Acquisition License (PAL).

Employees of Marty’s Electric Ltd. and Marty’s Outdoors (collectively, the “Sponsors”), their respective affiliates, subsidiaries, related companies, advertising and promotional agencies, are not eligible to participate in the Contest. For the purpose of these Contest Rules.

Sponsors shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to Sponsors for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. Sponsors reserve the right to disqualify any entry or entrant in their sole discretion, should any entry or entrant at any stage contain and/or supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

  1. CONTEST PERIOD. 2025 DRAW Contest (the “Contest”) starts at 12:00:00 a.m. Eastern Time (“ET”) on January 1, 2025 and ends on December 31, 2025 at 11:59:59 p.m. ET (the “DRAW Period”). All DRAW ENTRIES (defined below) must be received on or before 11:59:59 p.m. ET on the date defined for that DRAW (the “DRAW Deadline”).
  2. HOW TO ENTER. There is no purchase necessary to enter the Contest. Enter the Contest by using the appropriate methods described below. No entries will be accepted by any other means.

The contest is being conducted at Marty’s Electric store. While quantities last. One(1) item will be given to each customer or guest who purchases any one (1) of the following eligible items (each, an “Eligible Item”) during the contest period. Purchases can be made in store or by e-transfer to the email address provided .

 One section will be given to the person purchasing the PEN, the other section will be kept by the staff serving that person. Complete all requested information on the entry card including name and postal address and correctly answer, without mechanical or other assistance, the mathematical, skill-testing question on the entry form. When completed, the customer must deposit the portion of the card completed by customer in the customer entry box located at that participating store(s); the staff must deposit their portion of the card in the staff entry box located in their restaurant. No purchase necessary. For a customer to obtain a card without making a purchase, simply request one at a participating restaurant during the contest period (one card per person per restaurant per day, whether or not a purchase has been made). For a wait staff to obtain a card without a customer making a purchase, simply request one from that restaurant’s manager (only one card per person throughout the entire contest period)].

 

NOTE TO MINORS:

The Sponsor reserves the right, in its sole and absolute discretion, on a random audit basis or at any time and for any reason, to contact a Minor’s parent/legal guardian for the purposes of verifying their: (i) agreement that the Minor is to be legally bound by these Rules on the Minor’s behalf; (ii) consent to the Minor’s participation in this Contest; and/or (iii) consent to the collection, use and disclosure of the Minor’s personal information (see below for details, including the Sponsor’s Privacy Policy). Failure of a Minor’s parent/legal guardian to complete any such required verification to the complete satisfaction of the Sponsor may, in the sole and absolute discretion of the Sponsor, result in disqualification of the applicable Minor.

IMPORTANT NOTE RE: DRAW ENTRIES:

To be eligible to participate in the Contest and receive a DRAW (defined below), each entrant must have or obtain a Gun Dealer Online account (an “Account”), enrolled via the Website. Entrants may visit the Website to register for an Account. Accessing the Website and obtaining an Account is free of charge.

  1. AGREEMENT TO BE LEGALLY BOUND:

By participating in this Contest, each entrant (and, if a Minor, their parent or legal guardian) agrees to be bound by: (i) these Rules; (ii) the official Website and/or App Terms and Conditions, as applicable; and, (vi) all decisions of the Sponsor, which are final in all respects.

 

ALTERNATE METHODS OF ENTRY: NO PURCHASE NECESSARY.

To enter the contest without completing an Eligible Purchase as set out above, an eligible entrant may send a FREE request in writing, including: (a) the entrant’s first name, last name, age, and valid email address; (b) a statement indicating what the request is for; and, (c) a five hundred  (500) word or more unique and original handwritten essay (for greater certainty, the entrant must personally complete the essay and must not copy their essay from any third party, or any part thereof, nor submit that same essay, or any part thereof, more than once) on the topic of What is their favorite thing about Marty’s Outdoors store?; on a plain white piece of paper by mailing the fully completed request (in an envelope with sufficient Canadian postage) to: Marty’s Electric Ltd. and Marty’s Outdoors, 832 Main Street Unit 2, Perth-Andover, NB E7H 2W9 (collectively, a “Purchase DRAW Request”). Upon receipt of a Purchase DRAW Request in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion), the applicable entrant that submitted such Purchase DRAW Request will be provided with one (1) DRAW. The DRAW(s) received in connection with an eligible Purchase DRAW Request will be delivered via an email (to the email address the entrant provided and validated as part of their Purchase DRAW Request) that includes a unique URL (a “Unique DRAW(s) Link”) that the entrant must click-on, and then the entrant must follow the on-screen instructions to access the DRAW(s) via their Account. For certainty, Purchase DRAW Requests that do not indicate a valid email address will be ineligible to receive a Unique DRAW(s) Link. Essays which are not unique and original or which do not reflect the essay theme above are void. To be eligible, Purchase DRAW Requests must be postmarked by no later than the end of the DRAW Period and received before 11:59:59 p.m. ET on the date defined for that DRAW (the “DRAW Deadline”). Limit of one (1) Purchase DRAW Request per envelope with sufficient postage.

  1. PRIZES.
  2. Grand Prize.
  3. There will be grand prize or prizes (the “Grand Prize”) awarded from all eligible entries received to the Grand Prize Winner (the “Grand Prize Winner”) Grand Prize Winner is not entitled to monetary compensation between actual prize value and stated approximate prize value. If any portion of the Grand Prize is not used for any reason, no financial compensation will be awarded for the balance.

  6. For the purpose of the Contest Rules, the Grand Prize Winner and a Secondary Prize Winner shall be referred to as a “Winner” or “Winners”, and the Grand Prize and the Secondary Prize shall be referred to as the “Prize” or “Prizes”, unless otherwise specified herein.
  7. Prizes will be distributed within 30 business days after each Winner has been successfully contacted and notified of his/her Prize and has complied with the Contest Rules.
  8. Prizes must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of the Sponsors. Sponsors reserve the right, in their sole discretion, to substitute a prize of equal or greater value if the Prize cannot be awarded for any reason.
  9. Subject to applicable law, unclaimed Prizes will not be awarded. Prizes pictured in point of sale, television and print advertising, promotional packaging, and other Contest materials are for illustrative purposes only. Actual Prize(s) may vary from the Prize(s) pictured. In the event of any conflict between any promotion details contained in the Contest Rules and Contest details contained in point of sale, television and print, advertising, promotional packaging and other promotion media, the details of the Contest set forth in the Contest Rules shall prevail. In no event shall more than the number of each Prize described in the Contest Rules be awarded. Sponsors reserve the right to substitute any or all Prizes for prizes of equal or greater value,
  10. Each entrant shall be [or shall not be] eligible to win more than one (1) Prize.
  11. WINNER SELECTION AND NOTIFICATION.
  12. Grand Prize Winner shall be selected as follows:
  13. On date of the draw, potential Grand Prize Winners will be selected by a random draw from all eligible entries received. The odds of winning the Grand Prize are dependent upon the number of eligible entries received throughout the Contest Period. Proof of identification must be provided upon request. Before being declared the Grand Prize Winner, the selected potential Grand Prize Winner shall be required to answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question during a pre-arranged telephone call, to comply with the Contest Rules, and both, the potential Grand Prize Winner and his/her Guest must sign and return the Release.
  14. The selected potential Grand Prize Winner will be notified by telephone and/or e-mail no later than 2 business days and must respond within 30 business day of notification. The selected potential Grand Prize Winner, and the selected potential Grand Prize Winner’s response must be received by Sponsors within 30 business day of such notification. If the selected potential Grand Prize Winner does not respond in accordance with the Contest Rules, he/she may be disqualified, he/she may not receive the Grand Prize and another potential Grand Prize Winner may be selected in accordance with the Contest Rules. Sponsors are not responsible for the failure for any reason whatsoever of a selected potential Grand Prize Winner to receive notification or for Sponsors to receive a selected potential Grand Prize Winner’s response. In the event that the potential Grand Prize Winner and Guest do not comply with all the provisions as contemplated in these Rules, the Contest Sponsor shall have the right to disqualify potential Grand Prize Winner and Guest and draw an alternate potential Grand Prize Winner and Guest and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
  15. Secondary Prize Winners shall be selected as follows:
  16. Secondary Prize Winners will be selected by a random draw from all remaining eligible entries received. The odds of winning a Secondary Prize are dependent upon the number of eligible entries received throughout the Contest Period. Proof of identification must be provided upon request. Before being declared a Secondary Prize Winner, the potential Secondary Prize Winner shall be required to answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question during a pre-arranged telephone call, to comply with the Contest Rules, and to sign and return the Release.
  17. Each selected potential Secondary Prize Winner will be notified by telephone and/or e-mail no later than 2 business days and must respond within 30 business days of notification. Upon notification, the selected potential Secondary Prize Winner must respond by telephone to the contact number provided in the notification, and the selected potential Secondary Prize Winner’s response must be received by Sponsors within 30 business day of such notification. If the selected potential Secondary Prize Winner does not respond in accordance with the Contest Rules, he/she may be disqualified, may not receive a Secondary Prize and another potential Secondary Prize Winner may be selected, in accordance with the Contest Rules. Sponsors are not responsible for the failure for any reason whatsoever of a selected potential Secondary Prize Winner to receive notification or for Sponsors to receive a selected potential Secondary Prize Winner’s response. In the event that the potential Secondary Prize Winner does not comply with all the provisions as contemplated in these Rules, the Contest Sponsor shall have the right to disqualify potential Secondary Prize Winner and draw an alternate potential Secondary Prize Winner and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
  18. RELEASE. Grand Prize Winner, the Secondary Prize Winner and the Guest of the Grand Prize Winner will be required to execute a Release that confirms Grand Prize Winner’s, Secondary Prize Winner’s and Guest of the Grand Prize Winner’s: (i) eligibility for the Contest and compliance with the Contest Rules; (ii) acceptance of the Prize as offered; (iii) release of each of the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers, agents, representatives, insurers, shareholders, independent contractors, suppliers, sponsors, distributors, retailers and administrators (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of the Prize(s), including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iv) grant to Sponsors of the unrestricted right, in the Sponsors’ collective or individual discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use each of the Winner’s and Guest’s name, photograph, likeness, voice and biography, in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof. The executed Release must be returned within l [Indicate number of days] business days of the notification.

Notwithstanding the foregoing, the Grand Prize Winner, the Secondary Prize Winner and the Guest of the Grand Prize Winner must return the executed Release within l [Indicate number of days] business day of the notification or the selected potential Grand Prize Winner and the Secondary Prize Winner may, at the sole discretion of the Sponsors, be disqualified.

  1. LIMITATION OF LIABILITY. Sponsors assume no responsibility or liability for lost, late, misdirected or incomplete Entries, notifications, responses, replies or any Release, or for any computer, online, telephone, hardware, software or technical malfunctions that may occur, including but not limited to, malfunctions that may affect the transmission or non-transmission of an entry. Sponsors are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. Sponsors are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Sponsors are not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any prize. Sponsors assume no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsors, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest, the Contest Website and. In no event will more than the number of each Prize described herein be awarded. If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, there are more potential winners of any or all Prizes than contemplated in the Contest Rules, Sponsors reserve the right to conduct a random draw in accordance with the Contest Rules from among all remaining eligible entries to award the correct number of Prizes as set out herein. Sponsors make no warranty of any kind or nature with respect to any or all Prizes unless specifically required by law, including but not limited to the fitness for purpose or merchantability.
  2. CONDUCT. By entering this Contest, entrant agrees to be bound by these Contest Rules, which are available on the Contest Website www.martysoutdoors.ca and at 832 main street , Perth Andover NB throughout the Contest Period. Entrant further agrees to be bound by the decisions of the Sponsors, which shall be final and binding in all respects. All entries become the property of the Contest Sponsor and will not be returned. Sponsors reserve the right, in their sole discretion, to disqualify any entrant found to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest, the Contest Website, or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST BY ATTEMPTING TO FRAUDULANTLY PARTICIPATE IN THE CONTEST OR INFLUENCE ITS OUTCOME MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION. ENTRANTS ENGAGING IN ANY OF THE FOREGOING ACTIVITIES WILL BE DISQUALIFIED AND SHALL FORFEIT ANY PRIZE.

By entering the Contest, each entrant releases and holds the Sponsors harmless from any and all liability for any injuries, loss or damage of any kind to the entrant, Sponsors or any other person, including personal injury, death or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, any breach of these Rules, or in any prize-related activity.  The entrant agrees to fully indemnify without limitation the Sponsors from any and all claims by third parties relating to this Contest.

  1. PRIVACY / USE OF PERSONAL INFORMATION. By participating in the Contest, each entrant: (a) grants to the Sponsors the right to use his/her personal information for the purpose of administering the Contest ; (b) grants to the Sponsors the right to use his/her name, photograph, likeness, voice, statements about the Contest and/or Sponsors, prize information and/or biographical information for publicity and promotional purposes without further compensation unless prohibited by law; and (c) grants to the Sponsors the right to use his/her name and/or his/her city and province of residence in connection with the Contest Website, other related websites and/or in any other media now known or hereafter devised. Personal information will not be provided to any third party other than as provided for in these Contest Rules. Sponsors and any third party agents of the Sponsors will use personal information only for purposes related to this Contest and will be required to protect all personal information in a manner that is consistent with the Sponsor’s privacy policy which is available at [Include link to privacy policy].
  2. INTELLECTUAL PROPERTY. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by the Sponsors and/or their respective affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
  3. TERMINATION. Subject to the jurisdiction of the Régie des alcools, des courses et des jeux’s approval in Quebec (the “Régie”), Sponsors reserve the right, in their sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Contest Rules in any way, at any time, for any reason without prior notice.
  4. LAW. These are official Contest Rules. The Contest is void where prohibited by law and is subject to all federal, provincial and municipal laws and regulations. The Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial or municipal laws or the policy of any other entity having jurisdiction over the Sponsors. The Contest Rules are governed by the laws of the Province of Ontario All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and the Sponsors in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control. In the event that there is a discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, the English language version shall prevail, govern and control.
